Terms & Conditions

Definitions

  • Contractor: JR Creatives, based in Sayalonga, Málaga, registered with the Cámara de Comercio (Spanish Chamber of Commerce).
    Client: The natural or legal person who enters into an agreement with the Contractor.
    Services: All forms of content production provided by the Contractor, including but not limited to text, video, photography, and strategy.

Applicability

These general terms and conditions apply to all offers, assignments, agreements, and service deliveries between the Contractor and the Client.
 

Offers & Agreements

  • Offers are non-binding and valid for 30 days.
    An agreement is established once the Client confirms the offer in writing (email, WhatsApp, or other written form).
    Verbal commitments are only binding after written confirmation.

Execution of the Assignment

  • The Contractor will carry out the assignment to the best of their knowledge, expertise, and ability.

  • The Contractor has the right to subcontract (parts of) the assignment to third parties.

  • The Client is responsible for providing all necessary information, materials, and feedback in a timely manner.

  • Delays caused by the Client may result in adjusted deadlines and/or additional costs.

Changes, revision rounds and additional work

Unless otherwise agreed, one revision round is included as standard.
Additional revision rounds will be charged separately at the hourly rate or agreed surcharge.
Feedback must be provided within five (5) working days after delivery, unless agreed otherwise.
Changes to the original assignment may result in additional work and will be invoiced separately.
Additional work will always be discussed and agreed upon with the Client in advance.

Delivery & deadlines

  • Leverdata zijn indicatief. Tenzij anders overeengekomen, wordt levering binnen 14 werkdagen na de shoot of briefing gerealiseerd.

  • Levering vindt digitaal plaats via een downloadlink of gedeelde map.

  • Oplevering is voltooid zodra het eindproduct is verzonden.

Recordings

  • Drone footage is carried out in accordance with Spanish laws and regulations.

  • Contractor shall arrange registration, permits and insurance where necessary.

  • Due to weather conditions or government restrictions, a drone shot may be rescheduled or modified.

  • Additional costs resulting from necessary permits or alternative locations will be discussed in advance.

Rights & usage

  • All rights to supplied content (texts, images, etc.) remain the property of the Contractor.

  • After payment, the Client obtains a right of use for the agreed purpose.

  • Reuse or editing without permission is not permitted.

  • The Contractor is permitted to use work created for portfolio, social media and promotion, unless otherwise agreed.

Liability

  • The Contractor is not liable for damage caused by incorrectly supplied information or materials by the Client.

  • The Contractor is not liable for indirect damage, such as consequential damage or loss of profit.

  • Direct damage is limited to the amount of the order.

  • The client remains responsible for the use of the supplied material.

Billing & Payment

  • Payment term is 30 days after invoice date, unless otherwise agreed.

  • In the event of non-payment, the Contractor may suspend the work.

  • In the event of prolonged non-payment, statutory interest and collection costs are due.

Cancellation

  • In the event of cancellation by the Client after order confirmation, the Contractor is entitled to charge for costs and hours incurred.

  • Cancellation within 48 hours: 50% of the quoted amount.

  • Cancellation on the day itself or in case of no-show: 100% of the amount.

  • Relocation in bad weather will be arranged free of charge in consultation, unless costs are already involved.

Confidentiality

Both parties undertake to maintain confidentiality of confidential information obtained in the context of the assignment.

Applicable law & disputes

  • These conditions are governed by Spanish law.

  • Any disputes will initially be discussed in mutual consultation.

  • If no solution is reached, the dispute will be submitted to the competent court in the province where the Contractor is established.
